Receiving a Protection from Abuse (“PFA”) Order can cause you to feel a whirlwind of emotions. While PFA’s are meant to protect people from abuse, stalking or harassment, some people have used them as tactics in custody or divorce cases or even to unfairly evict someone from a shared living spaces.
Here are four things to consider when receiving a PFA complaint:
Read the ENTIRE complaint. It is important to read the complaint and look for the allegations, facts, evidence sited, protected parties especially if you have children with the other party) and the reasons behind the complaint.
Comply with any temporary orders or restrictions. Failure to comply with the orders can have legal consequences, including jail time, and can affect the outcome of your case.
Seek legal counsel. A PFA can have a multitude of ramifications. It can affect where you live, your custody of your children, you job, and your ability to carry firearms. An attorney can guide you through the process and help you understand the consequences of a PFA.
Gather evidence and document relevant information. Initially, your first hearing should be held within 10 days of the petition. You may be able to request a continuance, but you should work on gathering your evidence and witnesses as soon as possible. This may include text messages, emails, photographs, witnesses’ statements, or any other relevant information.
